Director of the company I worked for for 3 years 3 months, building it up from the ground actually as production manager, had a random meltdown over someone in my extended family, then used that, threatened our lives by shooting, locked us out of our home (company house), stopped our medical aid, took back our kids dog even which was a gift, to then eventually fabricate a retrenchment.
Their lawyer set this up easily as a client now orders every 2 months or so, instead of every month. Among this, they had just purchased around R300 000 in new horses. The director's husband (CEO) was still favorable to us and we kept in contact. In order for the retrenchment to work, they had to square up VAT & TAX that had been spent on vehicles etc as well, quickly do UIF etc.
This is where things become... well...
My retrenchment letter shows that I worked for 3y3m, but my UIF is short an entire year. They completely shorted me over R800 000 in commissions over the past 2 years of working there... with the 'promise' that things will be restored. I was convinced to get a new vehicle that would make life easier for me, working on farms the whole time... to which directly after, my commission was cut and I could do nothing about it. This is after I received pay slips, showing what my salary was going to be, the 'taxes I paid' and various other allowances I never received after this 'promise'
After the death threat if I returned with my family to get our own stuff out the house, I needed to move on and get my family out of that environment, and we just wanted to move on. So, they came with a separation agreement, to which they agreed to at least pay me what was owed for the past 2 months... but over 4 months. They only paid 3 months... breaking the agreement.
We are so broke and living with my mother in law who also lost everything after her husband died... 5 days prior to our death threat.
What can I do to at least get that little bit of money that is owed to me? Does their breaking of the agreement void the entire agreement... to which... is there a way for me to persue the commissions I worked for?
