Hi, my husband and I have been married for 4 years. He was previously married fathered two children with his ex wife. As per court agreement he paid R1000 per child. End of 2022 my husband had a conversation with ex wife to explain that he really can't afford the R1000 per child as we were expecting and he only earned R7000 at the time and couldn't really come out for our day to day needs. Never the less he started paying R800 per child instead of R1000 no formal agreement was made at the courts. Fast forward to Feb 2023 and his elders son moves in with us, also no formal agreement made he then pays only R800 to her as he had the one child living with him. He never asked for any assistance what so ever. Earlier this month Dec 2023 it was decided that his son would move back to his ex wife due to some disciplinary issues he moved back on the 10th of Dec 2023. We had decided since we already started the conversation of holiday cloths and so forth mainly Xmas cloths ,that we will still sort that out for him as promised. We ended up spending R3500 on him . Which is not the problem cause we promised him. The problem is that my husband usually makes maintenance payments on the end of each month. We sorted out the boys expenses on the 15th of Dec . Due to not having support whole year and the fact that the holiday expenses of the child made such a huge whole in our pocket we decided that we will only start paying maintenance for both children in Jan 2024. And will be only paying R800 towards the one child for this month. His ex wife is now threatening to take him to court and she said she is going to ask for all money she is owed because besides the fact that we only paid R800 per child she never received her 10% increase n.a . He earns about R9000 now ... This expectation is really unreasonable in this economy and we are barely scrapping by. Please advise on what we can expect at court should she proceed with her plans.
