Hi,I applied for a driver job at one of the company in Gauteng province,but I couldn't find it because of wrongfully creminal background check done on my behalf. What transpired is that my identity number was only used to do that creminal records check ,but not fingerprints.And found that from the SAPS database my identity number is linked with with a case of admission of guilty (driving without a license)of which I am innocent of that offence. When I consult with the SAPS database I found that indeed my identity number is linked to that offence and surprisedly the name and surname on that case are not mine,but only identity number is identical to that mine.Therefore,I asked if my identity number could be removed from SAPS database system. But,I was told my identity number cannot in any way be removed from the system as it is the duty of SAPS to keep all records of cases in their database. So I was advised that the only way to prove my innocent to whoever want to employ me is to make fingerprints through criminal records center (CRC)and get a name clearance certificate report,and of which I duly did.It came back written "No illicit activity identified". Therefore,I have to carry my name clearance report to any employer in order to prove my innocent in case a criminal records check is conducted. Sadly I carried that clearance report to the employer supposed to hire me but refuses to hire me because my identity number still appears on the SAPS database. THE PROBLEM I HAVE NOW. In this incident,I want to know if it is fair for a company to do criminal records check using identity number only and not using fingerprints? And if that company is accredited and licensed to do criminal records check? Because I really feel unfairly treated by not getting that driver job because of something that was wrongly recorded and I didn't do. Please help me, because I feel I have a case of suing the company did my criminal background check on my behalf for not following all proper procedure to to that. Regards, Martin Mbooi 0671128542
