Hello - from what i read in these discussion forums, management can and mostly do, get away with everything!  I am in a situation which has been going on for a year.  I am a sales consultant based in KZN and previously managing Gauteng as well.  I had some odd customers in Eastern Cape as well whom fell into my responsibility as no one was addressing their enquiries.  All these customers have gone to others, apart from KZN.  The management decision was i would work KZN (bearing in mind one person has the richest share with all territories north and north-east of KZN and on person doing EC, WC, NC and rest of Africa).  This is a bad jumble and so far no changes in levels of sales from any territories.  The differences here are the management interventions, thus we cannot say bad sales people.  We are now being micro-managed, asked to do searching for other divisions (team work i am told), and harrassed with negative, barbed comments - if the manager says stop and find this customer, it must be done NOW or i am accused of insubordination.  I am loath to take on someone else's finding of customers as we do not get commission for this. I do not want to resign as i like the products i sell, however the harrasment just does not stop.  The thing is where the manager's input is needed in decisions on pricing, marketing etc, she is not able to give difinitive decisions and keeps quiet.  I have recording of a telephonic conversation where she screaming at me, not allowing, or wanting my explanation, she made here mind up that my infraction was deliberate.  She has started trouble for me with MD and he is now coming down on me.

Labour lawyer says until i am fired there is nothgin much i can do.  So, i just carry on with this negative hammering away on a daily basis. Can they fire me for poor performance without counselling etc?  Is there anything i can do, like initiate allegations of victimisation or harrassmentt?  Can they change my job profile without my agreeing to the added responsibility without benefit to me?

Firstly your last question - they cannot unilaterally change your job profile without discussing it with you AND your consent.  

Secondly it is unfortunately true that they can get away with anything and your real recourse only starts once you are fired and can approach the CCMA.  You can always use a formal or informal grievance procedure, depending on whether your company has one.  But what will you really achieve?  You complain TO management ABOUT management.  Putting everything on record over time will however strengthen your case at the CCMA later.  Make sure you build a paper trial.

I am now trying to develop myself in a completely new area, and I hope that it will bear fruit. I read about the best sources of push traffic - I want to use this tool in affiliate marketing, and I believe that it can give very good results for an adequate price!
