I am at this company for 9 months now and i am still not permanent employed.When my 3 months probation period ended i asked about the contract they want to extend to another 3 months,saying they still need to see if i can do the work to their satisfaction.On the end of the 6 months i asked agian and the same story was used.Im on the end of the 9 months and asked agian and still the same story was given to me,saying (she) needs to see and make sure i can do my work.I asked and said that surely she can see after 9mnths if she wants me or not and needs to let me know what is going on cause i have a child to take care of and cant do anything and it is very stressful for me. Are they allowed to extend my contract for another 3 months,which would make it a year,what can i do?
it sounds as though they seem to have you on a fixed term basis..and this is something that should have been agreed to between both parties.naturally if you were employed with a probationary period, your contract should state whether you will be made permanent and when.
please refer to your letter of appointment in this regard.
If you were asked to resume / report back to work today, then why haven't you? you won't have any leg to stand on should you refuse to report for work. the employer may well regard this as absondment and leave you without a job.
It constitutes an unfair labour practice on part of the employer to continue putting you onto a temp basis, especially if you are under the impression that your contract would ahve been extended / made permanent.
