I have recently been awarded a substantial award from the CCMA for unfair dismissal and unethical labour practise. My previous employer has ignored all correspondence from the CCMA and did not even pitch for the Con/Arb. My question is this: the company I was with was registered as a CC but falls under a holding company. The previous employer has claimed that the business I worked for will be liquidated but no notification has been sent out. Can I claim the award through the holding company or what would my chances be to receive payment? There aren't any real assets worth mentioning, as the company I worked for was sharing premises with the holding company and 2 other businesses he owns. I would appreciate any advise from professionals in the know regarding CC's, liquidations and the like.
when it comes to liquidation of businesses, the employee is generally seen as the first creditor and the liqudator will make sure that all employees are paid, may not be the entire salary, but some of it!!

if your previous employer is not complying with the order, then you may approach the CCMA again in this regard as well as calling the department of labour, and if this doesn't work, you may well have to employ the services of an attorney to take the matter to the labour court, you may yourself initiate proceedings in this regard.
