I resigned from my previous employment in September 2009. My last pay slip reflected a deduction of R12,000.00 without any explanation (and I most definately did not owe the employer any money). In addition no payment was received for my leave (25 days). After several attempts to resolve this issue directly with my employer (they simply ignored my correspondence), I reported the matter to the Department of Labour in January 2010. They have paid several visits to my employer and keep getting excuses (new personnel, new board, waiting for their audited financial statements, etc.). The Department of Labour seems to accept this and simply re-schedule visits. Is the any other recourse for me - the amount owed is considerable (approximatley R50,000.00) without going to a lawyer? May I insist that the Department of Labour sort this out as a matter of urgency?
when something like this happens, you should first and foremost take it up with the ccma, lodge a formal complaint and a hearing will then take place and you will be able to state your case..and hopefully eventually claim your money. you did the correct thing by reporting unfair labour practice as this is what happened.. my suggestion is that you go to the CCMA immediately and report the matter, because by law you are entilted to any leave days owed to you.
