Good Day. Couple questions one regarding covid. At the beginning of the lockdown I was told to use my 20 days accumulated leave for the lockdown I am now being told unfortunately he is not paying me and I should wait for uif. Is that valid?
Secondly I operate a branch from home. With my husband now finding out I'm not getting paid he's querying why I should I should continue running the company from home not receiving pay nor receiving rent. Which I conveyed across to my employer. His response was he would gladly get a small office nearby however in lieu of the additional rental he would have to pay he would reduce my salary to accommodate it. Again is that valid?
Due to the COVID-19 pandemic many employers made radical decisions, that are not in line with the LRA or the BECA.
The unfortunate truth is that the Department of Labour should be called to investigate these issues but the department is closed to the public. The CCMA is also closed and refusing to hear matters, your relief mechanisms have been taken away. The Labour Relations Act and BECA do not make provision for this type of crisis, you do have an option to refer your grievances once everything is back to normal.
Remember that you will need to hold onto your job at this point in time as employers are struggling to stay in business. If you are retrenched or dismissed it would be difficult to seek relief.
Also keep in mind that if you and your employer enter into an agreement then you will be bound to that agreement.
