I have had to sell my house due to financial loss and the house sale went very quickly.
The new owners do not require my domestic servant.
She is not a live in maid but has worked regularly for me for 7 years.
I do understand that i need to pay one week of every year salary.
Does this include her travel costs as these I provided or only her basic salary.
I have applied for UIF Registration and am willing to back pay the 2% of her and my contribution for the 7 years. Can she still claim if not within 6 month UIF period ?
All in all I am offering 1 month basic salary plus 7 weeks of pay plus all UIF contributions.
Is this sufficient as a retrenchment package ?
Please advise as I want to be fair.
I have paid an average hourly rate to her of R 17.00 - excluding travel time.
I have also provided a daily lunch and monthly food pack of R 200 plus paid all travel expenses amounting to R 800 per month.
You would need to contact the Department of Labour as they would be able to assist you in this matter.
With regards to the retrenchment, the proposed amount that you have suggested would suffice completely. One weeks severance for each service of completed i.e. 7 weeks = 7 years Last months salary plus one months notice as the case may be.
I'm s domestic work I have asked my employer to write a retrenchment letter but she doesn't want to I in South Africa Gauteng and I am not working for her she said she doesn't have money to pay so where can I go to get help with this matter
