My client worked for a company in SA, they then signed agreement with him to worker in another country for 2 years. when he relocated with his family, the company then reduced contract to one year.
In total he worked for 15months then returned to SA. While in SA the company unaware continued to pay monthly for duration of 9 months. Only when my client signed the Voluntary retrenchment agreement +-2 years later, the company then said my client owes them +- 500K for the extra amount paid. When the severence pakage was paid out, the company deducted the whole amount of 600k at once. now my client is disputing why they had to deduct amount all at once instead of monthly as it is a large amount taken from his severence package.
Please advise if fair or not & on the way forward here?
