Good day I started on a temporary contract which was valid from 22 August 2016 to 30 September 2016,at a company in Cape Town. During this time a permanent post was advertised,for the same position I was temping for.I submitted my application and was invited for an interview. My application was successfull and I was told the good news by my supervisor.The news was also shared with all my co-workers in the department during our daily morning meeting,with everyone congratulating me. My Supervisor then told me that I will sign the permanent contract on Friday,30th September,which is when the temporary contract ends.However,on the morning of Friday 30th September 2016 he informed me that HR didn't have my permanent contract ready but will have it ready on Monday 3rd October 2016,for me to sign.Nothing was ready for me to sign on the Monday. On Tuesday 4th October 2016 I didn't attend work due to having diarhea.I phoned my Supervisor according to company policy.I was furthermore booked off sick for 9 working days with chronic diarhea and informed my Supervisor accordingly.Due to the nature of our work it is not advisable to be in the factory with diarhea. I returned to work on Monday 17th October 2016 and handed my sick certificates to my Supervisor. On Tuesday 18th October 2016,a "return to work" meeting was held between my Supervisor,second Supervisor and myself.They then informed me that I only have two days leave and that 7 days will be unpaid leave. On the morning of Wednesday 19th October 2016 my Supervisor informed me that I need to meet with the HR Manageress at 10am that same day. My Supervisor,HR Manageress and myself were present at the meeting.The HR Manageress explained that it was a councelling session.She started off by saying that my extended leave of absence was a concern to the company and they were concerned that the diarhea could be a recurring problem.She explained the impact that my absence had on the department. She then gave me a chance to explain my absence from work,from the beginning,which I did.She noted everything. The HR Manageress told me that the company thought it to be in their best interest to offer me a further 3 month temporary contract instead of a permanent contract as originally agreed.She also said that the 3 month temporary contract would be considered as my 3 months probation period.I agreed and signed the record of the councelling session. On the morning of Thursday 20th October 2016 I slipped and fell at work,hurting my left wrist,arm and elbow.I immediately reported this first to the department safety representative and then to my Supervisor.I was sent to the company nurse who checked and gave me pain tablets. Friday 21st October 2016,the morning the injury was worse.I couldn't move my wrist,my arm was paining and my elbow was swollen and bruised. My Supervisor sent me to the health and safety adminisrator so that he could complete an incident report.While I was with the health and safety administrator,my Supervisor phoned,asking him to tell me to go to HR. When I got to HR,the HR Officer took a photo of me for my staff pass (which is only issued to permanent staff).She then handed me a 3 month temporary contract to sign,which I did.The contract states that the company is not obligated to extend my contract after the 3 months. After all this I went to the doctor who sent me for xrays.The xrays showed a fractured wrist and elbow.The doctor then made an appointment with a specialist for Monday 24 October 2016. Furthermore,I have been booked off work,by the specialist,for 2 weeks from 24 October 2016 until 7 November 2016. I'd like to know what my rights are pertaining to the permanent contract that was initially offered,taking into account that I already signed the 3 month temporary contract. Was the company within their rights to retract the offer of permanent employment and change it to a 3 month temporary contract? Can I still insist that the permanent contract be re-instated? What action can the company take if I do? Please advise.
