I work in the financial services sector and my contract states the listed below.

 

Ordinary hours of work shall be Monday to Friday 0830-1730 with an hour lunch break to be taken between 1200 and 1400

"The employee hereby agrees that the nature of his responsibilities require that he works outside ordinary hours of work from time to time. No overtime or other benefirs will be paid or offered to him in respect of work rendered or undertaken outside of ordinary hours of work."

As a result my employer demands overtime as he pleases and i have worked

  • more than 12h on some days
  • there isnt a 12 hour break between when i leave work and start again e.g. leave work 3am and be expected back 830am with no remuneration or benefit

 

1. is it legal to demand overtime that is not remunerated?

2. is it legal to work more than 12h a day?

3. shouldnt there be a 12h break between finishing work and working again.?
