I have been employed by a company for one year. Payments of salaries were constantly late and circumstances eventually resulted in me being one of the employees volunteering for retrenchment. My last day of employment was 14 July 2016. They are still requiiring my services, but now it is on contract. Although they are unable to pay salaries and announced retrenchments, they are still employing people, who they can't and don't pay. It is now the 9th of the month. After continious efforts to get feedback from them, I have not been paid. Yesterday, some of us received half of our salaries, again without any communication or payslips. Half of the staff received their salaries on the last working day. Please assist me with advise, this is causing enormous distress both emotionally and financially. Also please advise about the tax deduction I can expect on my retrenchment package. They will deduct an amount without me having knowledge as to how much they are allowed to. They dont make tax payments in other words they "score" whatever they deduct.

Ultimately, if a business is not able to pay its staff, it is likely insolvent and the chances of retrieving your deserved salary are very low. You can apply to have the company liquidated, or you can report them to the Department of Labour and/or SARS (for the non-payment of your tax).

 

The tax amount itself is essentially calculated in an identical manner to your ordinary PAYE tax. They are legally obliged to do so, and hence the mere fact that they aren't paying that amount over to SARS does not mean that they may not deduct it from your salary.
