I wish to commence action against a company regarding unpaid remuneration.

The company is a registered PTY entity, but does not trade under this name, but under its t/a (trading as) name.

Must the summons be addressed to the PTY name, or the t/a name? I have asked the clerk of the civil court, but he does not know.

a lawyer want's to charge me R1500 for this advice.

The best answer will be to cite the company in its true origin example: "Company name (Pty) Ltd T/A trade name - a company duly registered in terms of the laws of South Africa with registration number _____________ and main place of business at___________"

My question however is why did you decide on this route? have you measured all remedies available to to you against its prospects of success and then decided on the small claims court or is this a decision made without exploring alternative remedies? maybe it is worth it to consult your attorney.
