Good day,

 

 

I started working for my current company just over a year ago.

Before I started working here (while we were discussing my possible employment) I was told I would earn 6% of turnover, as well as a basic of R10 000.

I was, at the time, employed by a reputable, stable company with many benefits. The reason I wanted to leave was due to the working hours, combined with the fact that I had a 1 year old baby and the 2 situations were not conducive to each other. I chose to look for alternative employment and heard about my current job, which I immediately pounced on. It involved a LOT of sweat, dirt, and greasiness, and I could not have been more excited.

The first day I started at this job, he decided to change the commission structure to 5% "because he was going to pay half my medical aid".

I agreed to wait 6 months before earning commission in order to establish myself in this industry. I don't expect something for nothing.

6 months went by - then he decided the 5% commission would be for spares sales only. A major portion of this company's turnover is based on labour.

It then changed AGAIN to 5% of spares, over R50 000.

So in rand amounts, as an example:

Turnover:

 

R200 000 (spares sales R62 500)

initial amount promised before commencing employment - 6%:   R12 000 before tax

1st change - 5%: R10 000 before tax

5% of spares: R625 before tax

 

In April of this year, he then said he wanted to change the structure again (raising the R50 000 to R67 000). So I stopped submitting my commission.

 

At the end of May he asked if I made commission for the month. So I spoke up about how I feel about him not sticking to his word - constantly changing commissions and the huge impact it has made on my life. I was going to use that money to buy a car for myself (in my previous job I had a company car and full petrol allowance). I am currently using my husbands company's bakkie (he works in a family business), which my employer tried to get me to use as a delivery vehicle. I complied a few times, and eventually I tactfully told him that the vehicle belongs to (husband's company name) and not (my employer's company) delivery vehicle, and that hubby's family was (rightfully so) getting irate at the fact that it was being used as such, with no financial compensation towards payments on the vehicle, wear and tear etc.

On discussion regarding the commission issue, he said he would buy a used bakkie and that would be mine - n lieu of commission. And I was also due for a raise (his words).

I said thank you, but please sleep on it before making hasty decisions. He insisted. The very next day, the bakkie was then in lieu of commission AND my raise.

With all due respect, I don't need him to buy me a car. I need to be able to feed my family and get through a month without having to beg and borrow just to make ends meet. If he stuck to his original word, I would be able to buy a car AS WELL AS be financially comfortable. I dont need to be MEGA WEALTHY (it would be nice!)

Basically, if the original commission structure wasn't promised to me in the beginning, and the current one was, I would not have taken this job. 

I have not deviated from my duties at all. I have implemented procedures in this company that has streamlined processes drastically, allowing for more time to focus on other things, such as growing the business - but of late I just have no "want", as I feel this is extremely unfair treatment.

And.... here is the crux...... I am STILL waiting for my employment contract. There is absolutely nothing in writing. (started here april 2015, its now June 2016)

I need some advice please.... what are my rights in this situation?
