Hi 

Thanks for taking the time to read, kindly advise on situation

 

I was pregnant and hospitalized for four months, I then went onto maternity leave for four months. I returned to work but was advised by my company that I could take more leave due to my baby still being in hospital. I was then called in 2 weeks later and was told that I will need to accept voluntary retrenchment and the company will pay me a package to leave as my child was sickly and this would be a strain on the company Or accept retrenchment after six months due to job becoming redundant.  I accepted voluntary retrenchment. I needed to submit a UIF claim and asked the company to complete my forms. I received the forms from them stating that I asked for the retrenchment and not the company. Can I take any legal action against them.

Good day,

Unfortunately you cannot claim Unemployment benefits if you voluntarily retire. This is because the UIF doesnt want situations where an individual works for 2 weeks then decides too quite and claim Unemployment benefits.
