Hi,

 

I would like some advise on some things that are happening at my company. I would like to know if this is in line with South African labour laws.

I am a cashier at a Casino and currently we were told that there is no policy for variances. A variance is when a cashier does not balance his/her float to zero. This variance can only happen when a cashier either over or under pays a client.

Currently the following is happening:

 

·         When a cashier has a variance he or she is called for a hearing.

·         The cashier is charged with not following procedures.

·         At the hearing the individual case is presented.

·         The outcome from the hearing is always the same the cashier is handed with a 12 month final written warning.

·         The final written warning is handed even if it on a first offence by the cashier.

·         Following the 12 month warning should the cashier have another variance he/she is called in and told that they need to resign and if they do not the company will black list them or have them arrested.

·         The cashier is strong armed into handing in a forced resignation letter immediately.

·         The staff member is not give a chance to rehabilitate themselves.

·         There is no corrective training or coaching done to help the staff member to rectify the initial mistake.

 

The above events are a weekly transgression, people are scared of being victimised.  I did enquire with the HR department about the final written warning and was told that this is in line with SA labour laws.

Is this process in line with our South African labour laws or is this an illegal act that my company is committing.

If it is contained within the companies disciplinary policy that you receive a final written warning which lasts 12 months, then they casino may do so. However the concept of resignation by definition is an act that is voluntary, you have chosen to resign, as a result no one can be forced to resigned. This is not contained in any legislation its is just a well understood concept. furthermore, if you choose not to resign then the casino will have to follow the appropriate procedure with regard to dismissal.   

 

I would also like you to qualify what you mean when you say "have you blacklisted" as far as I am aware only registered credit providers may blacklist individuals.
