Hi, I have been working for the same company for 21 yrs. Permanent for the first 11 years, then I worked on a part time independent contract 3 days a week, from 2007 to 2009. During that time I got paid per hour. No pay for any public holidays of leave pay when we had our compulsory shut down. In 2009 one of the office staff left and I came back to work full time. From that time I have been paid the same, per hour. I have not been employed as permanent staff, so basically I am an independent contractor. Am I not entitled to pet paid for the public holidays that fall during the week or any annual leave pay. I did ask if I could be employed permanently a while ago, but because of the Bee rules, they could not.
Thank you for your reply. As I work 38 hours per week, every week, I should be considered a permanent employee. Am I entitled to get paid for public holidays and leave pay?
I would like to discuss this with my employer that I am working for the last 21 years now. As I did mention, my permanent employment was broken for 2 years where I only worked 3 days a week. I have since come back full time again, 7 years now.
I have applied to the labout protect for R85pm, I am just waiting for a reply and membership no. Kind regards.
