Good day,

on manday i called in and informed my supervisor that im sick for duty. tuesday i went to the doctor and the Dr booked me off from tuesday till friday. the employer then said to me i must change the sick leave for monday to vaccation leave because i only have a sick note that covers tuesday till friday. i refused and refer them to the BCEA. in that i have two days that i can take without a sick note. "

23. Proof of incapacity

 

(1)           An employer is not required to pay an employee in terms of section 22 if the employee has been absent from work for more than two consecutive days or on more than two occasions during an eight-week period and, on request by the employer, does not produce a medical certificate stating that the employee was unable to work for the duration of the employee’s absence on account of sickness or injury." 

The eight week period is not applicable in my case. The employer deducted the madays wages from my salary without my consent and a pre leminary hearing. please help

This is a matter of unpaid salary. Refer the matter to the Department of Labour.
