I have a huge problem, about 2 weeks ago did our company strike over salaries, the director has stated that we are striking illigaly. The company has a person (Not working there) who have shares that is handeling this case. Today I received a letter stating that I should come to his office and explain why I participated in the strike, since the company intent to instetute disiplinary measures against the participants that can lead to dismissal for participation in a unlawfull strike. I did not participate! My car was damage by stones from the workers who blocked the entrance so I could not attend work! Many of the workers was arrested for assualt and damages. I donot know what a unlafull strike is or what I must do, do I need a lawyer? I cannot afford to loose my job.

In order for you to be dismissed, there will have to be a disciplinary hearing at which it will have to be shown that you breached a rule. If it is not proven that you participated in the strike, you cannot be dismissed. If you should then still be dismissed, you may refer the dispute to the CCMA for conciliation and arbitration.

Dear sir. The purpose of my letter to you was to inquire into this matter, I did not accuse you of any wrong doining we are simply attempting to find out what exactly transpired at the site location............ The rumors is incorrect since I had only one person arrested for assault, a broken bottle was thrown at one of my office staff, in him fending off the bottle as it was launched at him, the bottle severely lacerated his hand an severed a tendon, same that needed to be reatached in emergency surgery the very same day............. Yes I have shares and am I on the board of directors it does not mean that I cannot investigate this matter, I am sorry for your damages and the reason for our inquiry into this matter, all personnel received the exact same letter, over a period of 2 weeks will I interview all personnel and provide a detailed report back to the board of directors after which we will decide what recourse to take......... In sofar the dismissal is concern, I kindly refer you back to the letter in which I have warned against any future unlawful strikes that will lead to summery dismissal. At no stage did I indicate that you will be charged or dismissed, therefore I feel your "fear" is unjust, preemptive and not at all necessary.......... As you know we have given between 6-8% increases yearly, due to our expansion to Durban did we indicate that we will only provide 4% increase in next year, we invited employees (selected) to assist us within the new branch and lead the new employees accordingly, these selected employees was offered a 14th check due to he fact that they will work over december whilst we are closed, it is not wrong from us to compensate employees who accepted our proposal together with their yearly bonus............. The above seemed to have been the trigger or the strike since the organizers indicated that only "white people" received a 14th check, same not true as indicated above and in fact not just white people, your manager is a good example and one of the selected people......... Increases is not a matter of a "right" to employees and we are under no obligation to provide increases.......... The strike cost uss production and productivity, once I have completed my investigation, will I make my findings available to all personnel on the intranet and yes I will name all the culprits and intended action from the company......... Please understand that we value your safety above productivity, it will be unreasonable to penalize you for the actions of someone else, the same action that is circumstances out of your control..... I hope that I have explained the situation and that your fears are now set aside. Ps I believe congratulations are in order for the arrival of your son on sunday, may you and your wife have many joyful years with hi. Regards W.R
