I started working for my current employer in 1986 and had a 3 month break in service in 1992. I still work for the same employer. According to my employer, the duration of service is calculated from 1992 and not from 1986 as the break in service occurred before the BCEA 1997 came into effect in terms of which "... previous employment with the same employer must be taken into account if the break between the periods of employment is less than one year." Therefore my employer calculates my length of service as 23 years - in my view it should be calculated from 1986 i.e. 29 years of service. Is my employer correct in calculating my years from service from 1992 rather than 1986?
