S189(3) process - dispute on minutes of meetings (1st CPM) - Seeking advice
Permalink

Good day,

I am looking for advice from a labour lawyer as per below:

I'd appreciate if you could help me with the queries below.

I have a query regarding minutes that were taken by the FM in my 1st CP meeting on 1 Jul 15. I mentioned to the FM and director that their minutes were incomplete and omitted statements, so I presented them with my feedback in writing. Their labour lawyer chaired the 1st meeting.

In the 2nd meeting held on the 13 Jul, where the director chaired the meeting, they said they disagree with my feedback where I pointed out the omissions and that they won't update their minutes. They said I am making things up - it ended up being quite a heated debate towards the end of the meeting.

I am sure the minutes for the 2nd meeting will also be incomplete in some way so I doubt I'll sign them as well. And those 2nd minutes will state that both parties disagree on the original minutes and on my written feedback.

Query:     The director who chaired the 2nd meeting said that the purpose of signing of minutes is RECEIPT of minutes and not agreeing to its contents.
Aren't minutes used to document actions, statements etc. where both parts sign to AGREE to the contents of the document?

I believe that minutes can be/are legally binding?

Query:     My only option is to ask them in writing to respond as to which points they disagree with on my feedback to the 1st minutes in order to have that on record for both parties?

Basically, for both parties to agree to disagree in writing. Because trying to 'fight' them to be truthful will complicate the process and cause even more friction.

I am trying to have all of what goes on in this process in writing just in case. And I am struggling to find proof of the exact purpose of having minutes online, hence my request for your assistance.

Many thanks.
