We have a commission policy that retains R2000 of each claim and then if you hit your quarterly target they return the R2000 plus another R2000 bonus. The problem is they havent set targets for us and when questioned it was blamed on us that we didnt inquiry about our targets.  In the commission policy it also stipulates an annual incentive but when we questioned our GM he just said we would be so far behind it doesnt matter. Is this legal to retain commission if they havent followed the policy themselves?

Any agreement requires clarity. Try to ascertain in writing what the target is to prevent any confusion or denial later on. Should the employer still not comply, it becomes a matter of unpaid salaries and you can ask the Labour Department to send a Labour Inspector to make enquiries.
