Hi, I need advise please. I was on leave and whilst on leave one of our director's placed a staff member on Paid Suspension for being absent from work for 3 consecutive days, on her return she was very agitated to be at the office and created a very uncomfortable vibe bringing her personal problems to the office, this seems to be a habit of hers.  All this happened on the 29th of May 2015 and she is currently still on Paid suspension. on my return to work today I had a look at this situation and noticed she was not handed a Notice for a Hearing nor was she made aware of the actual charges of her dismissal by the director. He claims her behaviour in the office was very foul mouthed and unpleasant for all, and he typed a Suspension note up notifying her that she is placed on paid suspension with immediate effect until a formal disciplinary hearing can be held. She does not have any sick leave or annual leave left either as her personal matters have depleted all her leave. I need advise on what the next correct step is for us as well as if the paid Suspension is valid please.

This situation present with multiple errors made by the employer- this can lead to very serious consequences, firstly... Advice for who? The employer? Or employee? My reason thereto is not to waste time and the limited space available will not allow me to address all factors, the employee can take recourse and current situation might not promise success if done now, on the other hand the employer already laid down grounds that any union rep and/or other rep can use as proof to point fingers at he employer. Kindly advise accordingly... Rautenbach and Associates
