I am working for a company for 9 years. I recently exposed the wife and sister of the owner embezzling funds and reported it to the owner. Suddenly my salary is being cut and my car allowance is being taken away. Can the company force me to accept a salary deduction if I refuse to consent to it?

Firstly it is not my intent to promote conflict between employer and employee,however, I have seen this matters a lot and in my opinion it only ends 1 way if not intervened properly, that being an irreversible down spiral of financial losses, it is for this reason and this reason only that I provide the following advise........ This advise is given for this matter and should not be utilized just because its sounds "cool" (as my boy say) or for a personal vendetta against the employer in order "to proof a point"........................................................Firstly the answer to this question is no, the employer has no right to alter salary on a unilateral basis, this constitute unfair lab our practice as defined by the lab our relations act this include fringe benefits........... The intent of the employer is clear, you now need to arm and protect yourself and your benefits.......... More and more cases relating salary deductions are on the rise you should prevent harm to you rather than cure it, this is how to: 1. Immediately formulate a grievance and submit it to the employer- in this grievance you state that the employer has neglected and\or refused to consult you on this matter further that the employer did not take your personal circumstances into consideration (provide general income V expenses) and that you did not consent to this changes nor will you Vincent thereto........... Further that the employer did not provide reasons for the salary down scale and that you believe this is as result of the fact that you blew the whistle on illegal activities, same that you are protected against by the protective disclosure act.................. After you filed your grievance, immediately write the employer a letter and request that no unilateral changes should be made for a period of 30 days or until such time that your grievance is heard, whichever come first, you further place them on terms to restore any changes to its origin in 48 hours.........then you reveal your intentions, you state that unless they comply with your letter and confirm in writing indicating their compliance you will have no other remedy but to refer this matter to the cc ma......... Now the letter is not to scare the employer, but to comply and by showing your good faith intentions to cc ma and court, their noncompliance will count against them, don't get sidetracked let them tease you or tel you that they are not scared, it is fine because you have a game plan and are headed to the touchdown lane.......... In 48 :ours after you sent your letter and they did not comply, you refer this matter on a form 7.11 to the cc ma (available free on ccma.org.za website) make sure you sign section 10 of this form, now the lab our relations act state that a employer MUST comply with the request not to implement unilateral changes within 48 hours (section 64 (4) and (5)) you refer this matter as unfair lab our practice........ Once again don't get sidetracked stay on course and remember why you are doing this - to protect your benefits! ........... In recap, you have now lodge a grievance and on the same day you delivered your letter - 2 days later matter is in the cc ma -4 days since you started and the employer does not comply by restoring benefits (if taken away- reduced) you can now directly approach the lab our court and compel them on an urgent basis to restore your benefits, same that will remain intact for 30 days, remember you can only compel once they take or reduce benefits not before, so if they do nothing and end of this month just decrease salary and benefits, all your ducks are in a row to compel. Yes when you contact the lab our court they can provide you with an. Attorney free (legal aid) or contact lab our protect. Hope this help.
