My husband stopped working in September 2012. The company he was working for asked him to resign. During the last two years he got sick with dementia. He died on the 23 of November 2015. Can I still claim UIF, as he never claimed UIF during his life.

It is assumed that you meant November 2014.

 

Sections 30 and 31 of the Unemployment Insurance Act provide for the surviving spouse of a claimant to make a claim as a dependant to the extent that the employee would have been able to claim. Unfortunately the wording you have used throws some doubt onto the issue in your case. Since you claim he was asked to resign, he may not have been a claimant. Qualification for unemployment insurance can only occur where the employment contract was terminated by the employer, if the employee was dismissed, or where the employer goes insolvent. A resignation does not fall into those categories.
