I work at a small company that has been operating at an excellent level for the past 3 years, we had revenue of just under R10million last year and have a lot of work lined up for this year. The company has a CEO/owner, 3 full time workers and 2 labourers. We (3 full time employees) have just been informed that the CEO/owner will be "closing" the business. Two have been at the company 2.5yrs and one has been here 7 months. We have been offered a month salary, but the company is not insolvent, it is very profitable and the owner will still be operating as the company with the other employees on his own. He views this as the business closing, but the name is still going to be registered, and will still be operated as an entity consulting as well as working with another company. We view this as a retrenchment that has not gone through any procedure, nothing in writing etc. Do we have any legal right to try and fight this? Any advice would be most welcome! Thanks!
