If I resign with a 5 month notice period, can my employer terminate my employment before?

Hi,

 

I am planning emigration in the middle of the year. I need to notify my company of such, and thereby resign, but only with effect from the end of June 2015.

If I notify them that I am planning on emigrating and resign effective june 2015, do they have any grounds to terminate my employment before this?

If so, what are my other options?

Check your contract - it is unnecessary to give 5 months notice if your contract requires 3 months or a month, for example. Furthermore, your contract will usually state what options are available in that time. Sometimes a clause will state that by agreement, it will not be necessary to work through the notice period, and that the employment may be terminated before the expiration of the notice period.

For the most part, a notice period exists to allow the employer to make arrangements for replacing and training the exiting employee - such training which the exiting employee will most likely be tasked with. Hence, it remains unlikely that your employment will be terminated early.
