I have been given a company vehicle for the past 20 years under the guise of a "Tool of Trade". I have been allowed to drive this vehicle privately over this same period. The company has deducted Perks tax from my salary on a monthly basis for the personal use of this same vehicle.

Now the company has just informed me that they are taking this vehicle away with no compensation whatsoever.

Is this legal?

Do I have a claim on the company as this is "deemed" by myself to be part of my package?

Where do I stand?

The use of the vehicle may be legally taken away if the decision was procedurally and substantively fair. Substantively fair would mean that it made economic sense for the employer to withhold the benefit.

 

If it was not procedurally or substantively fair, it may be considered an unfair labour practice.
