The company I work for closed down for the December holiday period, so I’m not allowed to take leave during the year and the period the company closed in December for is considered my annual leave. I have applied for job at another company but not sure as to what my notice period will be? Do I need to give notice a month before the shut down starts of do I give notice on 1 December? If I give notice on the 1st December and the company close on the 19th December will the period that the company is closed be considered as part of my notice or will I have to work in the rest of the time after the company opens up again, and can my old employer deduct any money from my salary if I end my notice period end December? If the shut down period does count as part of my notice period what then of my leave days owed? According to my payslip I have 26 leave days at this time, so if I give notice on 1 December and my notice period is till end December, a total of 6 working days will be in the Shut down period, will those 6 days count as leave days? So my question on this is for how many leave days will my employer need to pay me out for if this is the case? If I give notice a month before the shut down period (20 Nov) then will I only e paid in December for half a month, or how much money can my employer deduct from my pay?

The notice period should begin a full calendar month before the date you intend terminating your employment. It does not matter if that time consists of annual leave or company shut-down.

 

The easiest thing to do is inform your employer a month in advance of your intention to resign, and to take it from there.
