I have been with a software company for just over a year.  I am a permanent appointment with the condition that I get paid only for hours worked.  My contract states:

"You will be paid 50% of paid billings one month in arrears.  "This package will therefore constitute total cost to company."

There is a separate section dealing with leave stating that I am entitled to 15 working days per annum.

I recently enquired about the number of days leave that I had accumulated, as I was under the impression that my leave would be accumulated based on the amount of hours worked rather than a fixed number of days per year.

I received the following response:

Due to you being a contactor and working per hour, we do no track your leave or had any leave forms logged.

You work on a per hour basis so there is no leave accumulated. I hope this clears things up.

 

Is this correct?  Am I not entitled to any leave for the hours that I have worked?
