I have a good relationship with my boss. Iam relocating at the end of the year and am currently job hunting in the new province. I do the type of job that can be done from any location thanks to modern technology and would like to discuss my plans with my boss and ask him if he would consider me still working for him remotely. What I would like to know is if he does not want me to (which is fine) can he then ask me to leave and terminate my employment knowing that I will be leaving in 3 months. Do you think it is a risk to discuss future plans with a boss. I only want to do this for two reasons - I would like to keep working for him and would like to work something out but also would like him to know my plans as it is only fair (I play a key role in the company) I want to do the right thing but don't want it to back fire on me

A valid reason for dismissal would be required to dismiss you. In this case, it is improbable that one would be found. The philosophy of labour law in SA encourages engagement between employer and employee.

 

Should you have a good relationship with your employer, it is not inadvisable to discuss your plans with him. However, the manner in which it is done is key, as you would not want to risk the possibility of sounding insubordinate or disrespectful. It would probably be better to raise it as a possibility for your future rather than a plan set in stone.

A further question would be whether you have discussed your intention to leave at all. If not, you must look at your contract to see what your notice period is. While in most cases it is a month, it varies and could be 3 months.
