Good Day,

 

I am having difficulty with Altech Autopage and have threatened to sue. I would like to know if i am correct in sating that i have legal grounds to do so.

 

My contract with was supposed to end on 31 July 2014. With their T&C's you have to give at least a 30days notice period if you wish to cancel the contract after the 24 month contract has elapsed, else it rolls over month to month.

 

I 1st called them about 2 months prior to 31 July to let them know of my wish to cancel. I was told it was too early to notify them and i would have to call again in a months time.

 

This seemed suspect, but none-the-less i called in a month later, week ending 29 June, and notified them of the cancellation. Call center agent said all was in order and it would be cancelled.

 

Low and behold come August it has not been cancelled. I called again to query why not and the agent didnt say why. She just said i needed to give 30 days notice so the contract will only end in August. I told her i had already gone through this procedure, but she said somebody would call me with 24hrs to assist with the issue. Not to my suprise, nobody did.

 

I laid a complaint about the issue and the gentleman handling the complaint came back with the same logic, that i have to wait 30 days and will only cancel at the end of August, which i refused.

 

1. They are breaching their contractual obligations set out in their T&C's

2. They still want to charge and bill me for usage for the month of August

3. Alternative for not billing for usage is to suspend my line

 

Im upset that even after i have told them of the situation where they didn't honour their side of the contract, they refuse to acknoledge their mistakes and still are trying to get more money out of me.

 

Their calls are recorded so their shouldnt be a lack of evidence. IF they aren't, mine are recorded because i work in a Bank. Between the calls and the emails i have plenty evidence.

 

Want to sue them for breach of contract, fraud, attempted theft,as well as unethical business practice.

 

Do i have a case here?
