Termination of Fixed Term Contracts
Permalink

I have been employed by an organization on fixed term contracts from 2005 to 2007, then 2008 to 2009, then 2010 to 2013 extended to 31 March 2014.

During the week of the 24th to 28th of March 2014 I was informed by my executive that a motivation had been put through the organization's board for a contract extension. The board sat on Thursday the 27th of March 2014. On the 31st of March I requested a meeting with my executive which did not materialize even though a time for the meeting had been set. I continued with work as usual as it didn't seem important to meet the exec on the day. On the 1st of April around midday I was called by the exec to be told that the contract extension had not been approved by the Board and that I had to do a handover that afternoon.

Is it reasonable for me to have had an expectation for contract extension based on the following:

1. My contract had been extended 3 times before;

2. In the past years I had received  contract termination notice letters from the HR department and this time around I did not received any letter. Other staff members had received 1 month, 1 week notice letters;

3. The board meeting was on the 29th and I was only informed about the decision on the 1st  of April around midday; I did make an effort to see an executive on the 31st but the appointment was not honored;I was expected to handover and vacate the office without the same afternoon. In the past my contract had been extended even  two weeks after the expiry date and therefore I had no cause for alarm.

4. On the 31st of March 2014 I still received written instructions for work which would not have taken half a day to complete;

5. Even after the 31st I was still expected to provide reports and information;

6. Even though client agreements were lapsing on the 31st of March 2014, the programme I was running still had funds and active projects across the country. My organization recoups management fees from this programme to cover its costs.

7. A non-core business staff member whose contract had lapsed and not extended has been reinstated due to risk of "publicity about racism".   The criteria

Please advise on what legal recourse I have against my former employer and the next steps I should take.

P/S All temporal/fixed term contract staff are experiencing the same or even worse terminations. Some are not being informed anything at all.
