I am trying to make a modification on a model on a service level agreement wrt the transportation of hazardous goods.
In terms of a road incident where there is an environmental spillage who is responsible for the environmental clean up? What does the law say?
The consignor of the dangerous goods or the transport operator? Both will claim from the insurance.
I would of thought in terms of cradle to grave responsibility the consignor was responsible.
My CEO wants to put it into the transporter responsibility but in my mind I have a gut feel it lies with the consignor.
