Hi there

I have a question with regards to interdepartmental transfers/promotions.

I was initially employed at my current employer within the Shared Services Department. I was then offered the opportunity of taking up a different role within the Creative department. I was put on a 3 month probation period for the new period however I never received a job description nor any reviews (even though I requested this).

The day before my 3 month probation ended, my line manager informed me that my position was basically becoming redundant and would be replaced by a more senior position and that I would be moved back to my previous position in the Shared Services department. They were advertising for the Creative position but couldn’t give me an indication as to when exactly I would move back to Shared Services.

 About 3 months have passed now and I now have a new line manager in the Creative Department. However, just before she started I applied for a managerial position within my previous department, Shared Services. I just found out on Friday that I have been successful but that my current line manager in Creative (who I don’t get on with) is basically trying to stall my taking up my new position as there won’t be anyone to fulfil my current duties (note, even though the position has been advertised for over 3 months). My line manager now wants me to stay in my current position until a suitable replacement is employed which could take several months. She is apparently also questioning whether I should in fact be allowed to take up this position in principle which doesn’t make sense.

My problem is that can they insist that I stay in my current position? Even though this will be to my detriment? The new position means better working hours and obviously an increase in salary which I am losing out on since I am being prevented from taking up my new position. From what I understand, if someone else from another department was in this position they would be allowed to take up their new post asap irrespective of the fact that their position would then by vacant. I am basically being retrenched from my current position yet I am now being forced to stay in the position because they haven’t filled the role yet and now I cannot take up my new position – is this my problem and should I be negatively affected because of it?

Can you please advise as to whether I have any recourse here and if so what I can do please as I would like to take up my new position without any further delays.
