HR Manager has no qualifications

Recently I was pulled into a diciplinary hearing for lack of performance, but I was never given any verbal warnings or anything of the sort before.

 

I also know for a fact, as does everyone in the company I am working for, that the supposed HR manager, who is also the CEO's PA, has no qualifications for the position. She has also been known to talk smack about employees to her friends within the company.

 

I would like to know:

 

1) Is this legal? Doesnt a company have to employ an HR person that has specific qualifications?

2) Was she allowed to sit in my hearing?

3) Was the company allowed to issue me a Written Warning without prior Vernal Warnings? 

4) I was never given anything to sign. Am I not supposed to sign something?

1. An employer has the discretion to employ who they wish in an HR position.

2. Yes. As long as she is unbias. She does not require qualifications to sit as chair.

3. Yes. As long as the offence is serious enough to justify this.

4. No. You should, however, be given the warning.
