I work in the recruitment industry. A little over 2 years ago, I placed 3 executive level contractors with a major, global company through another agency which has a preferred supplier agreement in place with the "employer". These contracts yield monthly income for my employer which exceed my own salary and I earn a small commission on each. Payments from the PSL supplier are now late and my employer warns she will be withholding my commission. My employer negotiated the terms of our agreement with the PSL supplier! I simply source candidates and present them. I have no relationship with the Employer and no influence over any of the parties. Is withholding my commission due to late payment by the PSL supplier an unfair labour practice? It will cause me immeasurable financial stress.
Remuneration disputes do not fall into the definition of an unfair labour practice, so no its not. Its may be breach of contract should you have agreed on the comission and it was included in your contract.
