The company I work for is under "Business Rescue." According to the company we are still employed and our contracts have not changed. Most of us were sent home 3 weeks ago and will not get a salary as we have not worked for the month. No work, no pay. What are my rights? We are put in a corner. We cannot claim UIF or draw from our pension because are employed. Is this all legal?

Under business rescue, the company must still pay its staff. I suggest you approach the department of labour.

Just another question.

What are the laws petaining to lay-offs? Do they have to pay a portion of our salary to cover medical aid and pension? What is the maximum period? As it stands, we now do not have medical aid nor a pension because of "no work, no pay," also, would it make a difference that the company sent the employees home before business rescue came into effect?
