ii have been working at the same place for the past 4 years. started there jan 2008 and my employer at that time never had a problem with the wristbands i wore. as long as the work got done. secondly due to my transport arrangements i often left work an hr to 30 mins early but i dont get paid for the time im not there which was never a problem again with the employer as she understood. even the past managers never had a problem with my wristbands or leaving early due my transport. last year the business was bought by a new guy and before he officially took over i informed him of my transport arrangements and since i dont get paid for the time im not there he said its ok no problem. all of a sudden this year my wristbands are a "hazard" to the company and i cant leave early because according to him certain employees are complaining why i can leave early and they cant. its clear hes being unfair to me because my previous employer afforded me these rights so he has to as well according to the labour laws. ive been wearing my wristbands for 4 yrs and there never was a single complaint from anybody. not a customer nor any employee or manager or my employer. isnt this unfair?

When a business is sold to a new owner, the employment contracts are transfered on terms that must not be less favourable than those that existed with the old employer. This does not mean that they must be exactly the same, only that they must not be less favourable. This would relate to your working hours only, would the fact that you are made to work extra hours be considered less favourable, probably not as you would be remunerated for the extra hours. Remember that an employer has a discretion to order the working environment as they wish in order to maximise profits and also to create a harmonious working environment. You could argue that this is what he is doing here, so as to create equality, i.e. everyone working the same hours. As far as the wrist band is concerned, you could find that your new employer might be a little more strict when it comes to the coccupational health and safety. If you can ACTUALLY prove discrimination then you could possibly challenge them, but i would imagine that their argument of hazard would probably gain some validity in terms of occupational health and safety. Negotiation is always the key, try and compromise and you might find the employer less strict.

Hi!I'm currently working for my father he started an engineering company we do a lot of work on mines ect . Now my problem is I have been working for him for bout 4 years but I have never signed any contracts what so ever.I feel its unfair because all his other employees have and the all get paid for days they not at work where as I don't. He tells me not to come in and then when I arrive there all employees are working . I really don't know what to do bout this . They take off tax ect but I can't claim unemployment ? .I'm really confused bout all this . . I'm probably gonna get some lame answer bout how everything is my fault . But I'm really sad bout all of this . And would like to know what to do in this situation? I have asked to sign a contract but the all say that I don't need to . .!?
