Good day Sir/Madam

Due to operational requirements of the employer, the employer then decided to close the Office. The Management has provided the employees with an alternative employment whereby they were given the options of three choices. The employees signed a new contract of employment on the 1st of December 2011 and then on the 22nd of December 2012 the employer withdrew the new contract of employment. The employer informed the workers that they will be informed about the new contract.

Does the decision of the employer to withdraw the contract of employment not amount to a Breach Of Contract? And what should we do as the employees to stop the employer from giving us new contracts?

If there has been consensus between the parties then the contract is binding, withdrawing it amounts to repudiation and as such, breach of contract. However, if consensus has not yet beeen reached, there is no contract and therefore no breach.
