Good day, I seek advise on my work contract. I started on the 28th October 2011 & was issued with a 3 year contract that states “should the employee resign anytime from the start date to 11 October 2014, the employee will be required to pay the employer the sum of 3 X CTC per annum as of the date of resgination”. I would like to know if this is legal as my probation period is about to end & I do not wish to stay on with this company as my superior is making it impossible for me to work as it is now a hostile environment. I also feel this contract was unfairly forced upon me as I had come in for the second interview & was asked to sign the contract there & then without any time to take the contract home & read through it thoroughly. Is this legal? Your assistance in this matter will be highly appreciated. can the company do this can they ask me to pay this money back, is is even legal to do so? or to even draft such a contract?what recourse do i have
I dont have to be a legal person to know and give an opinion that this contract is not legal.
This clause would probably be valid. Those who sign a contract must always beware as what they sign can have a serious effect on their lives. So , unless you were bullied into signing the contract or you were mislead about the clause, it applies.
