i seek assistance and advice on my problem which is as follows:-
i commenced employment in june and was on a 3 month probationary period from the june to august thereafter i was given a further 1 month probationary period in september given a poorly drafted contract to sign which i refused to sign i advised the hr department to provide me with a properly drafted contract which was not attended to. when i was advised of the 1 month further probationary period i was told that at the end of september and the period i will receive a performance appraisal.
at the end of september i asked for my performance appraisal to be done as advised by them and i was advised that they are busy and it will be done the following week. a week passed and when the day came still no appraisal. bear iin mind that all of this communication was with the legal manager and hr manager who conducted and still conduct themselves ina very unprofesional manner with regard to my situation.
the hr manager in passing told me "oh i still have to give you your contract but you know you are permanent you are getting paid every month". in the real world this means nothing without a written contract they can ask me to leave at anytime which they are capable of doing.
it has been 3 months since the end of my probationary periods which ended in september and i am still working here and to date they have not provided me with a permanent contract in writing or any contract whatsoever.
what can i do to dsafe guard myself so that im not suddenly asked to leave? and if i am do i have any grounds to take them up?
The fact that your probation was not extended after the further 1 months means that through their tacit approval you are now a permanent employee. You can keep asking them for a contract but its not longer essential for proving your permanent status.
