If an employer wants to retrench someone can they make them work during their so called 'retrenchment notice' period. Ie if an employer has told an employee at the beginning of June that they are going to stop employing them in November this year but that they must continue working until this date. Or should they pay them out and let the person go - one week for every year worked in cash. The person has worked for eight years as a domestic.
The employer has also failed to register the employee on UIF or pay UIF contributions. What is the position here?
Hi there. Generally if a person has paid "notice" money because of retrenchment, the retrenched person can expect to work the notice period. Sometime the employer will not require the retrenched person to work the notice period. This is common where the company closes. Company has retrenchment a few staff members but wants them to work till the last day eg 31.07.10. Notice period 01.07.10 - 31.07.10. Do the staff members lose any money calculated in package if they leave earlier,
It is good practice and good ethics to work until the last day unless negotiated otherwise with the employer. You will only get remunerated for the time worked during the notice period. If you only work two weeks, you will only receive two weeks' pay etc. It does not affect the severance package.
