Can the labour law be toughen against companies?

Hi, I overheard my manager and HR talking about getting rid of someone they don't like at work. What really disturbed me was that both parties were laughing about it and also saying that CCMA will maybe award this innocent person with 3 months salary. To me it sounded as if companies don't mind losing 3 months salary or less if it means having it their way. Can the law be toughen to restrict companies from ding as they like? Looking at the current employement rate in SA, it's not really nice to be losing your job at this stage. I feel like the labour law it's not tough enough to help innocent people.

Hi there,

Be glad that it wasn't you that were talking about and that you still have a job!! Do not get involved!! Most importantly, do not go and tell that employee and do not spread any rumours about you overheard either, if it comes back to you, there could be issues!!
As for the issue at hand, there really isn't anything that you or I can do as nothing has actually happened. Should this person eventually be let go, he cn claim up to 6 - 12 months compensation if the dismissal proves to be grossly unfair and the best way forward would be to report the matter to the CCMA. If you feel personally aggrieved, you can call the department of labour..
